NOW, THEREFORE, BE IT RESOLVED that the City Council of <br />the City of Orono hereby approves the plat of Hauser Lauer WCC <br />Addition, Hennepin County, Minnesota; subject to the following <br />condition: <br />1. A variance is hereby granted for Lot 2 to the 200' lot <br />width standard. <br />2. Lots 1 and 2 shall share the existing driveway access to <br />North Ferndale Road. Lot 3 shall be allowed a separate <br />driveway curb cut to North Ferndale Road, the location of <br />such curb cut to be approved by the Public Works Director. <br />3. Outlot A shall continue in golf course use, and any <br />future residential development of Outlot A shall require <br />City Council approval. <br />4. Outlots B and C shall remain in private ownership and <br />shall be maintained as a private road by the benefitting <br />surrounding property owners. Nothing in this resolution is <br />intended to prohibit the owners of Outlots B and C and the <br />neighboring property owners benefitted by access easements <br />over Outlots B and C, from forming a property owners' <br />association to jointly own and maintain Outlots B and C. <br />5. Prior to filing of the aforesaid plat, Mr. Lauer shall <br />execute a Developer's Agreement for construction of drainage <br />improvements required as part of the subdivision. <br />6. The aforesaid plat shall be filed by the City of Orono <br />with the Hennepin County Recorder's Office on or before <br />February 28, 1990 together with a certified original copy of <br />this Resolution and executed copies of the documents as <br />noted above. <br />The approval granted by this Resolution shall expire if <br />the plat has not been filed by the date specified above. In that <br />event, it will be necessary to file a new application with the <br />City of Orono for subdivision review. <br />Page 3 of 4 <br />
