2. Applicant must obtain an annual land alteration permit <br />from the City of Orono specifying amount of peat to be <br />removed, a plan for the work to be completed that year, and <br />a plan for erosion control. <br />j. Upon final approval of the proposed platting of this <br />property (Application #1366), applicant shall agree to <br />execute a Conservation and Flowage Easement that shall set <br />forth the special conditions of this conditional use permit. <br />If applicant has not filed for final plat approval by the <br />3eadline date of March 27, 1990 (per Orono Resolution <br />12610), applicant shall execute a Conservation and Flowage <br />::asement with the City no later than June 1, 1990 or this <br />conditional use permit shall be null and void. <br />•1. Authorities granted by this resolution run with the <br />property not with the applicant, but are permissive only and <br />rust be exercised by application for a building permit for <br />the retaining walls within one year of the date of Council <br />approval, or the special conditions of this resolution will <br />expire on that date (August 28, 1990). <br />5. Violation of or non-compliance with any of the terms and <br />conditions of this resolution shall constitute a violation <br />of the zoning code, shall automatically terminate any <br />authority granted herein, and shall be punishable as a <br />misdemeanor. <br />6. The undersigned applicant has read, understood and <br />hereby agrees to the terms of this resolution and on behalf <br />of himself, his heirs, successors and assigns, hereby agrees <br />:o the recording of this resolution in the chain of title of <br />.he property. <br />Page 3 of 5 <br />
