(hereinafter "City") and <br />legally described as follow-,: <br />Exhibit A (hereinafter "the property"); and <br />WHEREAS, per Section 10.03, Subdivision 19, Secti%,.. <br />10.55, Subdivision 8 and Orono Resolution #2610 (Condition No. <br />15), the applicant has made application to the City of Orono to <br />permit the annual excavation/removal of peat from the wetlands <br />located within the property on the south of the Luce Line Trail. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1433 <br />2. The property is located in the RR-lA Single Family <br />Lakeshore Residential Zoning District requiring 5 acres of <br />area, 2 acres of which must be contiguous. The property <br />consists of a total of 20.56 acres. <br />3. The Orono Planning Commission reviewed this application <br />on August 21, 1989 and recommendE.. -proval of the proposed <br />variance and conditional use permit, based on the following <br />findings: <br />A) Per Orono Resolution #2610, Condition 15, the <br />applicant was directed to file a conditional use permit <br />for the annual removal of peat used in the commercial <br />growing of plants on the property. <br />B) In a report dated August 17, 1989 by Glenn Cook, he <br />noted that "the continued excavation of the wetland . . <br />. on a limited scale (300 cubic yards) will have a <br />minimal effect on the marsh". <br />Page 1 nf 5 <br />
