Burgess, Jr., 2610 West Lafayette Road - <br />Variance/Conditional Use Permit <br />Zoning District - LR-lB, sewered, 1 acre <br />Application - Request for variance and conditional use permit to <br />replace existing residence with new residence, including <br />excavation in 0-75' zone to create a walk -out. <br />List of Exhibits <br />Exhibit A - Notice of Planning Commission Action of 7/18/89 <br />Exhibit B - Staff's Letter to Applicant of 7/21/89 <br />Exhibit C - Applicant's Information Packet Submitted to <br />Planning Commission <br />Exhibit D - Memo & Exhibits of 7/13/89 <br />Discussion - <br />Please carefully review the memo and exhibits of Jiily 13th. <br />Briefly, applicant is proposing to remove the existing residence <br />on this property and replace it with a new residence that meets <br />the 75' setback, but requires a hardcover variance to remain at <br />the existing 33.7% in the 75-250' zone. He proposes to use a <br />"grass paver" pavement system to accomplish this. <br />Additionally, integral to the project is an excavation along <br />the lakeshore bank to create a walk -out configuration. <br />Planning Commission at their July 17th meeting voted 5-0 to <br />recommend denial of the request for various reasons, including: <br />1. Lack of hardship to justify this magnitude of variances. <br />2. Excavation proposed is excessive in relation to the need <br />to protect lakeshore banks. <br />3. Hardcover at 33.7% in 75-250' zone is excessive given <br />the lot size. <br />4. This situation is not so unique as to justify an <br />exception to the City's lakeshore grading policies. <br />
