City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />1649 <br />4) The City Council has considered this application <br />including the findings and recommendations of the <br />Planning Commission, reports by City staff, comments <br />by the owner and other interested persons, and the <br />effect of the proposed variances on the health, safety, <br />and welfare of the community <br />5) -The City Council finds that the conditions existing <br />on this property are peculiar to it and do not apply <br />generally to other property in this zoning district: <br />that granting the variances would not adversely effect <br />traffic conditions, light, air nor pose a fire hazard <br />or other danger to neighboring property; would not merely <br />serve as a convenience to the owner, but is necessary to <br />alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of the <br />owner; and would be in keeping with the spirit and intent <br />of the Zoning Code and Comprehensive Plan of the City <br />Conclusions, Order, and Conditions <br />Based upon the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.24, Subdivision <br />5(B) to permit the construction of a single family residence on a <br />property that consists of 0.39 acre instead of the 1.0 acre required <br />with lot width of 128 feet instead of the 140 feet required, subject <br />to the following conditions: <br />1) All buildings to be located within the standard LR-lB <br />building envelope: 35'.front; 30' rear; 10' side setbacks <br />2) Maximum hardcover on the lot to be 4,227 square feet or <br />less including buildings, driveways, patios, decks, etc. <br />3) No current or future variances granted for any other <br />performance standards requirements' <br />4) Payment of standard building permit fees including SAC <br />and Park Dedication Fee at the time the permit is issued <br />5) Payment of $1,081.45 sewer hookup charge with building <br />permit <br />-2- <br />
