MINUTES OP THE ORONO COUNCIL MEETING OP JULY 24, 1989 <br />HOME OCCUPATION LICENSE-2620 KELLY AVENUE CONTINUED <br />had 2 distributors that met with him for approximately 1 hour <br />between 8:00 and 9:00 a.m. every day. He believed his business <br />generated less traffic than that of persons selling Amway or <br />Tupperware products. He said that he has no commercial signs and <br />has only two chest freezers that he uses to temporarily store the <br />frozen food until it is picked up by his distributors. The <br />vehicles used for distribution are taken home by the distributors <br />with the exception of two trucks that he parks in his driveway. <br />He said that an unusual situation occurred last winter and he had <br />6 trucks parking in his driveway. Since that time he sold 2 <br />trucks and has only a total of 4 trucks. He said that he would <br />only require an office for 2 hours a day which world not be <br />feasible. <br />CounciImember Goetten asked whether there were any other <br />concerns expressed by the Building Inspector^ Mabusth replied <br />that Mr. Pritchard had addressed each of the specific concerns. <br />She said that the City's Ordinance prohibits a home occupation <br />from having employees and from storing an excessive amount of <br />inventory. Mr. Pritchard's business violates both of these <br />standards. She said that the Ordinance does not deal <br />specifically with this case. <br />City Administrator Bernhardson said that the questions are <br />whether the Home Occupation Ordinance incorporates the general <br />policy of the City and whether Mr. Pritchard meets the standards <br />of the current Ordinance. Bernhardson said that Mr. Pritchard <br />does have delivery trucks coming and going and his business is <br />very noticeable. <br />CounciImember Nettles said that the violation of the <br />Ordinance was that the business was visible from the street. <br />CounciImember Goetten said that she would be willing to <br />approve this license if Mr. Pritchard could alter his business to <br />conform to the Ordinance. She said that the traffic concerned <br />her. Mr. Pritchard said that he would try to minimize the amount <br />of traffic. <br />Acting Mayor Calla^ion said that approval in previous cases <br />such as this have "come back to haunt the City". Bernhardson <br />also explained the precedent setting danger if this application <br />was approved. <br />It was moved by Acting Mayor Callahan, seconded by <br />CounciImember Nettles, to deny this Home Occupation application <br />for 2620 Kelly Avenue. Bernhardson suggested that Mr. Pritchard <br />be allowed a grace period of 120 days to find another alternative <br />tor his business. Motion, Ayes*3, Nays»0, Motion passed. <br />HIGHWAY 12 SAFETY IMPROVEMENT <br />City Administrator Bernhardson requested that this item be <br />tabled until such time that further information is received back <br />from the Minnesota Department of Transportation. <br />4,4
