Response: The property consists of approximately 3.5 acres total land area. Unique characteristics of <br />the marsh covering approximately 2.5 acres of the land area, combined with the evolution of the city <br />code over time, has resulted in the pre-existing decks (constructed nearly forty years ago) no longer <br />meeting the requirements of the current code. As a result, a variance is required in order to re- <br />construct the decks due to the administrative conflict caused by the intersection of city code and the <br />natural topography of the subject property. <br />9. The conditions do not apply generally to other land or structures in the district in which <br />said land is located. <br />Response: The conditions requiring this variance are unique to the subject property. <br />10. The granting of the application is necessary for the preservation and enjoyment of a <br />substantial property right of the applicant. <br />Response: The variance is necessary to maintain the property's existing and long-standing decks in a <br />safe and reliable manner. <br />11. The granting of the proposed variance will not in any way impair health, safety, <br />comfort, morals, or in any other respect be contrary to the intent of the Zoning Code. <br />Response: The variance will not in any way impair the health, safety, comfort, or morals of others. In <br />addition, the variance is consistent with the permitted use of the property under the subject Zoning <br />Code. <br />12. The granting of such variance will not merely serve as a convenience to the applicant <br />but is necessary to alleviate demonstrable difficulty. <br />Response: The variance is necessary to maintain the property's existing and long-standing decks in a <br />safe and reliable manner. <br />69
