A RESOLUTION REGARDING THE PENDING � • 1979 DOCK LICENSE FOR GAYLES MARINA WHEREAS, Gayles Marina Corporation, (hereinafter the "applicant") has applied for a 1979 Commercial Dock License; and WHEREAS, the City Council of Orono has publicly told the applicant that a11 dock structures must comply with City and LMCD - dock use area regulations and that failing such compliance, the City intends to deny the 1979 license and intends to proceed with ' prosecution for violations of dock use area regulations ; and WHEREAS, the ap�licant has several times publicly stated his intentions to loca te all dock structures in compliance with LMCD and �City dock .use area regulations ; and WHEREAS, the City Council appreciates the desire of the applicant to conform to the dock use area regulations and the City Council con.tinues to respect the good faith efforts of the applicant and �he applicant's attorney in resolving the differences between • the parties,• NOW, THEREFORE, BE IT RESOLVED,' that the City Council of . the City of Orono hereby wishes to place in the public record the following understanding: • 1. Gay1e Wittig, President Gayles Marina Corporation, , has promised and does again promise tfl provide the LMCD and the City with a, certificate of survey showing the actual shoreline at elevation 929.4 feet MSL, showing the dock use area per the LMCD code including side setbacks -and a maximum� extension-200 feet lakeward from 929.4, and showing the existing and/or proposed dock locations for 1979 in � conformance with said regulations. � � . 2. Because of the weather or other delays beyond the control of the applicant, the applicant has been :unable to provide said survey ' to the City and the LMCD but the applicant continues to promise early delivery of said survey. � - 3. The appli'cant has promised to begin removal of all dock structures existing beyond 200 feet from shore before placing any boats in the water for the 1979 season arid has further promised to • • provide to the City and the LMCD, on a copy of the certificate of survey, a complete plan showing how all the applicant' s docks are to be constructed during the 1979 season. r ..
