A RBSOLOTIOM GRAMTIHG <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) <br />PILE #1416 <br />WHEREAS, Jeffrey Eccles (hereinafter "the applicant") <br />is the owner of the property located at 3025 Sixth Avenue North <br />within the City of Orono (hereinafter "City") and legally <br />described as follows: <br />Exhibit A, attached (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.28, Subdivision 5 <br />(B) to permit the construction of an attached garage to be <br />located 15.2' from the side lot line where a 30' side yard set- <br />bac)c is normally required. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1416. <br />2. The property is located in the RR-lB Single Family <br />Rural Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on July 17, 1989, and recommended approval of the proposed <br />variance based upon the following findings: <br />A) There will be minimal visual impact on the <br />neighborhood. <br />B) No additional run-off will be directed to the <br />neighboring property. <br />C) The affected neighbor h.ss expressed he has no <br />objection to the proposal. <br />D) The new garage will be located in the location of <br />the existing garage and driveway. <br />E) Other locations for the garage would conflict with <br />well or septic system, or would not be appropriate <br />given traffic pattern of rooms in the house. <br />Page 1 of 4
