The principal structure met zoning standards at the time of construction <br />in 1969 and was allowed to be constructed 25' instead of 30' from the <br />rear lot line. <br />D. The interior layout of house limits construction of addition to the west <br />side. <br />The Orono Planning Commission dc,,;ee the 4' x 12' deck and stair structure to <br />the northeast side of the proposed addition based upon the following findings: <br />A. Installation of the deck would encourage further structural encroachment <br />of the substandard rear setback of the structure. <br />B. Further intensification in use created by rear deck addition will only <br />magnify problems associated with the already substandard residential lot. <br />4. The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />arartina the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />5. The Citv Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the Orono City Council <br />hereby grants a variance to Municipal Zoning Code Section 10.28, Subdivision 5 (A) to permit <br />the construction of a 2'/--story, 20' x 28' addition that will require a 21.2' or 42.2% rear <br />setback variance and an 8' 6" or 17.2 `7o street setback variance and denies the request for a 4' <br />x 12' deck and stair addition requiring a 24' or 48% variance, subject to the following <br />conditions: <br />Pa_e 2 of 6 <br />1W.
