Cosby <br />Village Admin_strator <br />Box 66 <br />Crystal Bay, Minnesota 55323 <br />Dear Sir: <br />On November 30, I received a letter from Mike Scheller requesting <br />that I apply for a permit for the pond constructed on my lot with Mr. <br />Scheller's verbal assurance. Since Mr. Winchell (who is adjoining) <br />and I have the same problem we had already determined that I would <br />do the legal investigation required for both of us by the rather complex <br />situation. I enclose a preliminary letter from our attorney on the <br />subject. <br />Mr. Winchell and I selected Ed Montgomery to delve into this for us <br />because of his forty so-ne years of experience with Municipal Zoning. <br />For many years Mr. Montgomery was the city attorney for St. Louis <br />Park and has been and is connected _n a similar capacity with several <br />smaller villages. <br />Even though Mr. Montgomery has spent c lerable time going over <br />the Orono ordinances, I am sure that he u, s A feel the invesitgation <br />has been as complete as it should be, particularily in view of the fact <br />that there could be civil liability involved. An in depth examination <br />would require the examination of council minutes and other research <br />that neither Mr. Montgomery or Mr. Winchell or myself have had time <br />fo r. <br />Even though Mr. Winchell and f wish to cooperate in every gray with <br />the council, we must beg for an extension of time as required _n Mr. <br />Scheller's letter for the following reasons: <br />1. The technical requirements set out in the application form <br />could not be completed within the time span set out under <br />the letter. <br />
