TO: James Cosby, Village Administrator <br />FROM: Mike Scheller, Building Inspector <br />DATE: October 25, 1973 <br />SUBJECT: Ferrell-Winchell Drainage Problem <br />In the spring of 1972, Richard Dunlap took out a building permit to <br />construct a new residence at 60 Cygnet Place. When he was landscaping <br />his yard, he asked if it was all right to construct a small wild life <br />pond. I gave him verbal permission to do this. This was not in any <br />wetlands. I was of the opinion at this time, that I was allowed to <br />do this as an aftermath of the Willow Drive reconstruction, when I <br />was informed I had some leeway as long as it was not wetlands. <br />This summer I was informed by the Ferrells that water from the Winchell, <br />the neighbor of Dunlapp, pond was deliberately channeled across their <br />property to the creekbed running through their property. I was not <br />even acquainted with Mr. Winchell and never authorized a pond on his <br />property, let alone a channel across the Ferrell property. <br />There would not have been a problem except in the process of dredging <br />the pond a spring was opened which kept flowing and the natural way <br />for the water to flow was toward the Ferrell property and the creekbed. <br />I met with Mr. Ferrell, his son, Mr. Dunlap and Mr. Winchell to arrive <br />at a solution to the problem. Mr. Winchell offered to pay to bury a <br />tile across the Ferrell property to solve the problem. Mr. Dunlap <br />asked to delay action, to see if he could buy the land from Mr. Ferrell <br />for his son. <br />Mr. Dunlap came to Bey office a week ago and said he was still negotiating <br />and had come closer than the $12,500 offer and the $16,500 asking price. <br />
