' <br /> CA <br /> A RESOLUTION GRANTING CONDITIONAL USE PERMITS <br /> PER MUNICIPAL ZONING CODE <br /> SECTIONS 78-1114 SUBDIVISION 2, 78-1117 <br /> AND 78-1366 AND VARIANCES TO MUNICIPAL ZONING <br /> CODE SECTIONS 78-282, 78-1112, AND 78-1288, AND DENYING <br /> A VARIANCE TO MUNICIPAL ZONING <br /> CODE SECTION 78-1279 SUBDIVISION B <br /> FILE NO. 04-3012 <br /> WHEREAS, Roger D. O'Shaughnessey, a single person (hereinafter "the <br /> applicant") is the owner of the property located at 1265 Brackett's Point Road within the City <br /> of Orono (hereinafter the "City") and legally described as follows: <br /> Attached as Exhibit A(hereinafter the "property"); and <br /> WHEREAS, the applicant has made application to the City of Orono for a <br /> conditional use permit per Orono Municipal Zoning Code Section 78-1114 Subdivision 2 and a <br /> variance per Orono Municipal Zoning Code Section 78-1112 to allow grading and filling <br /> within the flood fringe; and <br /> WHEREAS, the applicant has made application to the City of Orono for a <br /> conditional use pennit per Orono Municipal Zoning Code Section 78-1366 to allow chimney <br /> heights in excess of 30'; and <br /> WHEREAS, the applicant has made application to the City of Orono for a <br /> variance per Orono Municipal Zoning Code Sections 78-282 and 78-1288 to allow hardcover <br /> within the 0-75' setback from the OHWL; and <br /> WHEREAS, the applicant has made application to the City of Orono for a <br /> variance per Orono Municipal Zoning Code Section 78-1279 Subdivision B to allow a fence <br /> within the lake yard; and <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> , -'1 till 'I's 1 <br /> Page 1 of 6 <br />
