Exhibit B and depicted on the attached Exhibit D (the "Drainage, Utility and <br /> Ponding Easement Area"). <br /> The Drainage and Utility Easement and Drainage, Utility and Ponding Easement are collectively <br /> referred to as"the Easements"and their respective easement areas are collectively referred to as"the <br /> Easement Areas." <br /> 3. Scope of Easement Rights. <br /> a. The Drainage and Utility Easement includes the right of the City,its contractors, <br /> agents, servants,and assigns,to enter upon Drainage and Utility Easement Area <br /> at all reasonable times to: (1) locate, construct, reconstruct, operate, maintain, <br /> inspect, alter and repair within the Drainage and Utility Easement Area storm <br /> sewer, sanitary sewer and water facilities, ground surface drainage ways, or <br /> other public facilities or improvements of any type that are not inconsistent with <br /> public drainage and utility use; and (2) grade, level, fill, drain, pave, and <br /> excavate the Drainage and Utility Easement Area; and (3) cut, trim or remove <br /> trees,bushes,undergrowth, and other obstructions interfering with the location, <br /> construction, and maintenance of the Drainage and Utility Easement or <br /> Drainage and Utility Easement Area. <br /> b.
