� O� <br /> O � 4 � <br /> • - � CITY of ORONO <br /> ,� - ... � <br /> ; ti <br /> ��L �G~' RESOLUTION OF THE CITY COUNCIL <br /> `�kESIIOg' NO. e5 �. s�9i � <br /> A RESOLUTION <br /> " DENYING THE PAUL ODE APPLICATION <br /> FOR ON-SALE LIQUOR LICENSE <br /> AT 3425 SHORELINE DRIVE <br /> WHEREAS, the City of Orono is a inunicipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS,Paul Ode(hereinafter "the applicant"),has made application to the <br /> City of Orono for an on-sale liquor license for the property at 3425 Shoreline Drive <br /> NOW,THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Mirulesota: <br /> � FINDINGS <br /> 1. The City's authority and concern in its review of the Paul Ode on-sale liquor license <br /> application is the protection of the public health, safety, and welfare. The City's review <br /> of the application has addressed this concern in two ways. One is through an application <br /> review and background investigation by the Police Department. The second is through a <br /> review of the impacts on the area properties of granting the on-sale liquor license. <br /> 2. The Orono Police Department has recommended denial of the license based on the <br /> Department's background investigation of the applicant, as well as on false statements <br /> made by the applicant on the application form. <br /> 3. The proposed liquor establishment is in very close proximity to the adjacent low density <br /> residential development. The entrance is oriented toward the adj acent residential <br /> development, and the parking area is located directly adjacent to the low density <br /> residential development. <br /> 4. There is no buffer between this site and the residential property. <br /> 5. The experience of the Police Department indicates on-sale liquor brings the potential for <br /> increased noise,public disturbances, litter, traffic safety issues, and other activities that <br /> are incompatible with low density residential development. <br /> • <br /> Page 1 of 3 '�. ;� ' '1y, , <br /> : � � ';� <br /> , :� j� '" �{ <br /> ,. <br /> ?� � :� ' .� .� � <br />
