The City Council has considered this application including the findings and recommend- <br /> ations of the Planning Commission,reports by City staff,comments by the applicant and <br /> the public,and the effect of the proposed variance on the health,safety and welfare of the <br /> community. <br /> 6. The City Council finds that the conditions existing on this property are peculiar to it and do <br /> not apply generally to other property in this zoning district;that granting the variances <br /> would not adversely affect traffic conditions,light,air nor pose a fire hazard or other <br /> danger to neighboring property;would not merely serve as a convenience to the applicant, <br /> but is necessary to alleviate a demonstrable hardship or difficulty,is necessary to preserve <br /> a substantial property right of the applicant;and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings,the Orono City Council hereby grants a <br /> variance to Orono Municipal Zoning Code Section 78-305 to allow construction of a new residence on <br /> a lot approximately 1.7 acres in dry buildable area and 160'in width in the LR-1 A Lakeshore Residential <br /> Zoning District where lot area of 2.0 acres and 200'width is normally required;and a variance to Section <br /> 78-1112 to allow hardcover within 26'of a City-protected wetland where no hardcover is normally <br /> allowed subject to the following conditions: <br /> 1. Council approval is based on the site plan submitted by the applicant and annotated by City <br /> staff, attached to this Resolution as Exhibit B. Any amendments to the site plan which are <br /> not in conformity with Citycodes will require further Planning Commission and City Council <br /> review. <br /> 2. Applicant shall provide a survey prior to issuance of a building permit for construction of anew <br /> residence,that contains complete topography for the site sufficient to satisfy staff that wetlands will <br /> not be encroached except as allowed by this approval. <br /> 3. Prior to footing inspection,applicant shall provide a wetland delineation surveyto verify the wetland <br /> boundary and to confirm the actual dry buildable area of the site. <br /> Page 3 of 6 <br />
