The MCWD has reviewed this proposal and has made the following <br /> recommendations with regard to storm water and erosion control on <br /> the site: <br /> i. The proposed project requires Best Management Practices <br /> (BMP) and rate control to fulfill the stormwater management <br /> requirements of Rule N. The applicants' proposal to convert a <br /> 3' wide area along the West property boundary from gravel to <br /> MN wild grasses and the installation of a rock drain with a <br /> skimming structure has been deemed adequate. <br /> ii. The applicants are to install erosion control measures <br /> . consisting of a silt fence for the site during construction. <br /> 4. The Minnesota Pollution Control Agency has granted the applicants an <br /> � Industrial Storm Water Permit and the applicants have submitted to the <br /> PCA a Storm Water Pollution Prevention Plan(SWPPP). <br /> 5. The City Council has considered this application including the findings <br /> and recommendation of the Planning Commission, reports by City staff, <br /> comments by the applicants and the public, and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> 6. The City Council finds that the conditions existing on this property are <br /> peculiar to it and do not apply generally to other property in this zoning <br /> district; that granting the variance would not adversely affect traffic <br /> conditions, light, air nor pose a fire hazard or other danger to neighboring <br /> property; would not merely serve as a convenience to the applicants,but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicants; and would be in <br /> � keeping with the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> NOW, THEREFORE BE IT RESOLVED that the City Council of <br /> Orono, Minnesota hereby approves the commercial site plan, building elevations, and <br /> landscape plan referenced above and approves the variances to Orono Municipal Zoning <br /> � Code Sections 78-1288 and 78-1468 based on the unique findings and hazdships noted <br /> Page 3 of 6 <br />
