Background: <br />The City of Orono adopted a final plat (Resolution 7586). The applicant requested an amendment <br />to the stormwater drainage trunk fee for the site. The final plat identified a stormwater drainage <br />trunk fee of $47,384.10. The original development for Crystal Bay Business Centner paid a <br />stormwater drainage trunk fee as part of the 2007 development. <br />After reviewing the Orono ordinances, there is support to waive the charges for a supplemental <br />stormwater and drainage trunk fee in addition to what Ryan Companies previously paid. <br />Sec. 14-288(2) ("Credit for past payments") provides: "If a lot for which the trunk fee was paid <br />under a past subdivision is then itself subdivided, no additional trunk fee will be charged if the <br />original trunk fee was based on the entire acreage of the parcel now being divided." The letter <br />notes that Ryan paid the fee for the "larger site that includes my client's current proposed <br />development..." Assuming this is correct and verified, the foregoing provision would seem to <br />apply. <br />Based on the provision above, staff supports waiving the stormwater trunk fee due to the nature or <br />type of development. <br />3.
