the City may use the Letter of Credit to complete the Public Improvements required under this <br />Agreement at Developer's expense. If a building permit is submitted as required above, the <br />Commercial Site Plan Approval shall not lapse for any of the other Lots, except as provided in <br />Section 5 herein. <br />5. CHANGES IN OFFICIAL CONTROLS. For five (5) years from the date of <br />this Agreement, no amendments to the City's Comprehensive Plan or official controls shall apply <br />to or affect the use, development density, lot size, lot layout or dedications of the approved Plat <br />or each Commercial Site Plan unless required by state or federal law or agreed to in writing by <br />the City and the Developer or its assigns. Thereafter, notwithstanding anything in this <br />Agreement to the contrary, to the full extent permitted by state law, the City may require <br />compliance with any amendments to the City's Comprehensive Plan, official controls, platting or <br />dedication requirements enacted after the date of this Agreement. <br />b. CONDITION FOR SUBSEQUENT APPROVALS. The entire Development <br />has received Commercial Site Plan Approval. Therefore, additional City review prior to <br />construction of future buildings or renovation of the existing building. on Lot 3, Block 2, will be <br />limited to Building Permit Approval by City Staff. All structures shall be built consistent with <br />the Commercial Site Plan Approval. <br />7. IMPROVEMENTS. <br />A. PUBLIC IMPROVEMENTS: The Developer shall install and pay for <br />the following Public Improvements: <br />1. Streets: <br />a. Orono Industrial Boulevard <br />b.
