COLORADO 80202 <br />rw 303-625-2660 <br />Ct X_ OF, VRWO <br />Per your request, Resolution No. 1163 approving a side <br />yard variance for Steven Haverberg was sent to the county <br />for recordings on Haverberg's property. It was discovered <br />that Haverberg's property is Registered or Torrens property. <br />The Hennepin County Torrens office will not accept <br />resolutions for recording on Certificates of Title. <br />There are two reasons for the Torrens department not <br />accepting this resolution. First of all, the subject <br />matter of the resolution is not necessarily of a real <br />estate nature, rather it is of an administrative nature <br />dealing with City business. Secondly, the Torrens office <br />in general, hesitates to accept any resolution from any <br />city to be recorded on a Certificate of Title. Their <br />reasoning is that once the resolution becomes a memorial <br />on the Certificate, and the existing property owner or <br />new property owner wishes to remove such a memorial, a <br />court proceeding must ensue costing between $300 and $500. <br />I have experienced this problem in the past, with the <br />Torrens department as regards recording resolutions from <br />cities. <br />
