Applicants shall remove all gravel hardcover on the adjacent right-of-way and <br /> establish suitable vegetative groundcover by September 30, 2005. <br /> 5. Required removals of structure and hardcover sha11 be completed prior to the <br /> footing inspection for the new residence. <br /> 6. The approvals granted by this variance resolution shall not be valid until the <br /> applicants have entered into an Agreement with the City regazding their <br /> Vegetation Restoration Plan including appropriate provisions and financial <br /> security to assure execution. No temporary or permanent Certificate of <br /> Occupancy shall be issued until the Vegetation Restoration Plan has been <br /> executed to the City's satisfaction. <br /> 7. Authorities granted by this resolution run with the property not with the <br /> applicants, but are permissive only and must be exercised by obtaining a building <br /> permit for the new construction within one year of the date of Council approval, <br /> or the variance will expire on that date (Februaxy 28, 2006). <br /> 8. Violation of or non-compliance with any of the terms and conditions of this <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a misdemeanor. <br /> 9. The undersigned applicants have read, understand and hereby agree to the terms <br /> of this resolution and on behalf of the applicants and the applicants' heirs, <br /> successors and assigns, hereby agree to the recording of this resolution in the <br /> chain of title of the property. <br /> Adopted by the Orono City Council on the 28`t' day of February, 2005. <br /> Page 4 of 6 <br />
