Y `� � � � . <br /> kESYi� � <br /> � <br /> � <br /> � A RESOLUTION AUTHORIZING THE CITY OF ORONO <br /> � TO EXTEND AN AGREEMENT FOR THE USE OF � <br /> � HENNEPIN COUNTY' S ELECTRO1vIC PROPIETARY DATA BASE <br /> � <br /> � WHEREAS, the County has developed an electronic proprietary geographical <br /> ( infonnation data base which was designed using an automated mapping faciliry software product, <br /> � which proprieta.ry geographical digitized data base is hereinafter referred to as "Electronic <br /> fProprietary Data Base" (EPDB) and which is described in the Hennepin County Conditional Use <br /> ± License Agreement attached hereto and hereby made a part hereof; and <br /> ; . <br /> i <br /> � VVHEREAS,the City of Orono desires to use the County's EPDB,and the City has <br /> 1 retained the consulting engineering firm of Bonestroo Rosene Anderlik (BR.A)to provide seivices <br /> l to the City, a.nd the City and BR.A desire to use the Cotanty's EPDB in the course of conducting the <br /> • � City's business; and <br /> # WHEREAS,the County intends that any additions and inodifications to the EPDB <br /> � relating to tlie Coltnty reinain wholly compatible with the Coiulty's EPDB for the period of the <br /> � copyright and information added to the data base by either the County or the City shall be made <br /> � available to either party; and <br /> i <br /> ! <br /> ; WHEREAS,in acknowledgment of the Eiitity's above stated puipose,the Cotuzty is <br /> � agreeable to provide to the City and BR.A access to the EPDB described in Exhibit A; and <br /> r <br /> jWHEREAS parties agree that the execution of this Agreement is necessary in order <br /> 1 to adequately protect said EPDB; and <br /> 1 <br /> WHEREAS on Jttly 12, 1999 the City Council approved Resolution No.4321 <br /> iauthorizing executioii of the Hennepin County EPDB Conditional Use License Agreement; and <br /> � <br /> ; NOW,THEREFORE,be it resolved that the City Council authorizes extension of <br /> � the Hennepin County EPDB Conditional Use License Agreement through December 31, 2005. <br /> i <br /> Adopted by the City Council of the City of Orono this l Oth day of January, 2005 <br /> • ATTEST: <br /> _- Lin a S.
