' <br /> WHEREAS, the City Council has determined that it is necessary aiid in the public <br /> interest tliat the City acquire by eminent domaixl a perinanent drainage easeinent for public <br /> � piuposes at the location hereinafter specified. � <br /> WHEREAS, the City Council lias ordered preparation of a resolution authoriziilg the . � <br /> talcing of such easement by eininent domaiii, a.iid �uthorizing the City Attorney to corrunence � <br /> condei�ation proceedings. � <br /> THEREFORE,BE IT RESOLVED,by the City Council of Orono: . <br /> • - 1. That it is hereby determined that the taking of a permanent drainage easement for � <br /> public purposes over the parcel of land set forth in paragraph 4 hereof is necessary <br /> and in the public interest. � � <br /> 2. That the City shall acquire by eminent domain a permanent drainage easement for • <br /> public purposes over the paxcel of land set forth in paragraph 4 hereof, and that the <br /> City Attorney is hereby authorized and directed to commence condemnation <br /> proceedings, including a motion for "quick-talce" transfer of title and possession in� <br /> the District Court of Hennepin County and for appointment of Commissioners to <br /> determine the damages, if any, sustained by those persons with interests in the <br /> property as a result of such taking. � . <br /> 3. That the City Attorney is hereby fiuther authorized to acquire such permanent <br /> drainage easement through settlement with those persons with interests in the <br /> property,if such permanent easement can be acquired through settlement. � <br /> 4.
