<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. 7589 <br /> <br /> <br />2 <br /> <br />documentation from a licensed professional engineer regarding the necessity of all of the <br />constructed walls; and to provide an updated landscape plan to screen all of the walls from the <br />lake; and <br /> <br /> WHEREAS, on April 28, 2025, the City Council reviewed the Applicant’s request and the <br />recommendations of the Planning Commission and City staff. Council voted 3 in favor and 1 <br />opposed on a motion to table the application until the identified information was submitted; and <br /> <br />WHEREAS, on May 2, 2025, after receiving direction from the Planning Commission and <br />the City Council, the Applicant provided updated information from the professional engineer <br />regarding the justification for the additional walls; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby approves the request for a CUP amendment supporting retaining walls upslope from the <br />rip rap and the walls supporting the proposed stone lake access stairs within the bluff and 75- <br />foot setback from the lake as amended and described above based on one or more of the <br />following findings of fact concerning the Property: <br /> <br />FINDINGS OF FACT: <br /> <br />A1. The analysis contained within staff memos and the exhibits attached to the aforesaid <br />memos, all minutes from the above-mentioned meetings, and all other materials <br />distributed at these meetings are hereby incorporated by reference. <br /> <br />A2. The Property is in the LR-1B, One Family Lakeshore Residential Zoning District. <br /> <br />A3. The lakeside slope on the Property is defined as a Bluff. <br /> <br />A4. The Property is within Tier 1, and hardcover is limited to 25% according to the <br />Stormwater Quality Overlay District. The Applicant proposes 14.1% total site hardcover. <br /> <br />A5. The Applicant applied an amendment to the Conditional Use Permit (Resolution No. <br />7486) to allow construction of additional stone retaining walls to support the lake access <br />stair and the lower slope within the bluff and the 75-foot lake setback. <br /> <br />A6. In considering this application for CUP amendment, the Council has considered the <br />advice and recommendation of the Planning Commission and the effect of the proposed <br />project upon the health, safety and welfare of the community, existing and anticipated <br />traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on <br />values of property in the surrounding area. <br /> <br />301
