iiL0 <br />0 <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />G& NO. 7564 <br />ikESHO <br />A RESOLUTION APPROVING <br />THE PRELIMINARY PLAT FOR "SKY BLUE WATERS" <br />FILE NO. LA25-000001 <br />WHEREAS, Tom Bray(the"Developer") on behalf of Edward H. Hamm Jr., Trustee of <br />Amendment and Restatement of Trust of Edward H Hamm dated October 10th 1995", who is the owner of <br />the property addressed 485 Orono Orchard Road South and legally described within Exhibit A (the <br />Property"); <br />WHEREAS on January 6, 2025, the Developer applied for Preliminary Plat approval to <br />subdivide the Property into two buildable lots; and <br />WHEREAS, as part of the preliminary plat review, the Developer requested the City <br />terminate the Declaration of Subdivision Covenants dated July 9, 1999 and recorded in the office of the <br />Hennepin County Recorder on April 14, 2000, as Document No. 7285795 (the"Declaration"); and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono Zoning and Subdivision Codes, on February 18, 2025, <br />the Orono Planning Commission held a public hearing for the application at which time all persons <br />desiring to be heard concerning the application were given the opportunity to speak thereon; and <br />WHEREAS, on February 18, 2025, the Planning Commission reviewed the application <br />and recommended by a vote of 6 to 1 that the City Council grant preliminary plat approval and <br />terminate the Declaration, as applied; and <br />WHEREAS, the City Council reviewed the proposal at a regular meeting held on <br />March 10, 2025, and hereby makes the following findings with regards to this application: <br />FINDINGS <br />Al.This application was reviewed as Zoning File LA25-000001. <br />A2.The Property is guided in the 2040 Orono Community Management Plan (CMP) for Rural <br />Residential, 1 unit per 2 acres. The proposal involves the creation of 2 lots at 0.11 units per acre. <br />The northern lot provides future subdivision opportunities; the project provides the opportunity to <br />meet the CMP goals with a future subdivision. Staff finds the proposed plan brings the site closer to <br />conformance of the CMP and meets the intent of the density goals at this time. <br />A3.The proposal is consistent with surrounding development. <br />1 <br />157
