. -� o� <br /> � <br /> o � o . <br /> • � C ITY of ORONO <br /> � -- : � <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��`q Og'�G NO. � � � � � <br /> k'ESH. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings,the Orono City Council hereby grants a <br /> variance to Orono Municipal Zoning Code Section 78-305 to permit the construction of a single family <br /> residence on a lot of 29,700 s.f.or 0.69 acres in dry buildable area where a lot area of 87,120 s.f.or 2.0 <br /> acres is required, subject to the following conditions: <br /> 1. Council approval is based on the site buildable envelope plan attached to this resolution as Exhibit <br /> A. No variances other than this lot area variance will be granted for the property. Construction � <br /> of a single family residence shall adhere to the standards of the LR-lA zoning district and the � <br /> Orono Zoning Code. � � <br /> 2. The following conditions of approval shall be adhered to: <br /> a) The delineated wetland and a 26'buffer around its perimeter shall be subject to a <br /> • Conservation and Flowage Easement which will disallow any fillulg or structures within the <br /> wetland and buffer area. <br /> b) An additional drainage easement shall be required along the route ofthe ditch,to the 1012' . <br /> elevation contour. No filling,slruciures or obstructions maybe allowed within the drainage <br /> easement. <br /> c) All structures shall be set back a ininunum of 10'from the drainage easement,to allow for <br /> protection of the structures and to allow access to the rear of the house. <br /> . d) The lot shall be subj ect to the standard LR-1 A setbacks of 50'front and rear,30'on the <br /> sides. The various setback requirements noted here and above result in a buildable <br /> envelope approximately 50' deep by 75'wide. <br /> e) A driveway to access the site shall be located so that it meets the required wetland <br /> setbacks and does not encroach the drainage easements. <br /> fl The lowest habitable floor elevation shall be no lower than elevation 1014'. <br /> g) Prior to Council action on the variance application,applicants shall provide for City <br /> • Engineer approval a schematic house design and grading plan showing how a11 of the above <br /> conditions can be satisfied. <br /> Page 4 of 7 . <br />
