The applicant has fulfilled all of the directives <br />of the resolution. "*he plat and associated documents will be <br />filed by the City upon the ordering of sewer and water to the <br />property (please review Exhibit K). <br />Please review Exhibit P, concerns of the neighbors were an <br />important issue during the Council's review and the developer has <br />resolved these concerns. <br />The special conditions and guidelines for the development <br />and future residential use of the property are referred to in the <br />final plat resolution, the resolution approving the conditional <br />use permit for the planned residential development, and in the <br />private covenants (Exhibit J). Note that the conditions set <br />forth in the PRD/Conditional Use Permit cannot be amended by the <br />private homeowners until the City approves. This is also set <br />forth in the private covenants. The special conditions of <br />approval by the City are singled out in the covenants and future <br />owners are advised that no amendments can be made to these <br />specific sections of the covenants unless the City approves. The <br />conditions of the conditional use permit resolution also gives <br />the City the ability to enforce the special conditions of the <br />planned residential development. Please review the documents, as <br />staff would appreciate your comments. <br />Scaff recommends approval of Mr. Rebers' Planned Residential <br />Development and subdivision based on the findings and conditions <br />set forth in the approving resolution.
