Please note that applicant provided detailed hardcover <br />calculations but no diagram keying the calculations, so <br />staff reviewed hardcover independently per Exhibit G. <br />5. There is approximately 6% hardcover in the 250-500* 2one. <br />No change is proposed. <br />Discussion - <br />The Planning Commission is requested to visit this site to <br />get a first-hand view. From the standpoint of average lakeshore <br />setback, the residence to the northwest will not be impacted at <br />all. The residence to the southeast will not lose any lakeviews, <br />but note the pool water surface being 12.5' from the side lot <br />line, with pool surround being approximately 6' from the line. <br />Applicant is proposing to surround the pool with shrubbery. <br />Perhaps the more significant question to ask is whether fencing <br />around the pool will be required by the applicant's insurance <br />company, and if so, how would that fencing affect the adjacent <br />neighbor, the Nelsons at 679 Minnetonka Highland Lane. Note that <br />those neighbors have signed an acknowledgement that they are <br />aware of this application. Staff has received no comments from <br />them. <br />Regarding hardcover, this property has hardcover <br />concentrated in the 75-250' zone and the excessive hardcover is <br />taken up by the large driveway area, plus some fairly extensive <br />landscape beds. <br />To be generally consistent with past practice, staff would <br />suggest that concurrent removals of hardcover on this property be <br />considered, to result in no increase in hardcover. Remember that <br />the pool water surface is not considered as hardcover for <br />calculation purposes. The 1,377 s.f. of additional hardcover <br />associated with the new deck and pool surround is nearly <br />equivalent to the areas of landscape rockbed areas. Removal of <br />plastic from all rockbed areas would result in a net increase of <br />about 110 s.f. of hardcover. It may then also be reasonable to <br />require that some portion of the driveway or parking area be <br />removed. <br />Staff Recoanendation - <br />If Planning Commission finds that the location of the pool <br />will have no significant impact on :•>'<& views enjoyed by the <br />neighboring property owners, a recommendation for approval of the <br />average lakeshore setback variance would be appropriate. <br />Regarding the hardcover request, it would be consistent with <br />past practice if the Planning Commission were to recommend that <br />equivalent hardcover be removed so that the result is no net <br />increase in hardcover above the existing 37.1%, if Planning <br />Commission feels a variance is justified.
