It, before the entire improvement cost assessed or to <br />be assessed against the property in the benefited area is paid in <br />full, the Subdivider, its heirs, succssors or assigns, transfers <br />such property or a portion thereof, the Subdivider hereby agrees, <br />for itself, its heirs, successors and assigns, at its own cost and <br />expense to pay the entire unpaid improvement cost assessed or to be <br />assessed under this agreement against the property to be <br />transferred. If any such transfer is made before the special <br />assessments have been levied, the Subdivider shall pay the City a <br />sum of cash ual to the City Engineer’s estimate of the special <br />assessments for Plan B Improvements that will be levied against the <br />property to be so transferred. The Subdivider shall be liable to <br />the City for any deficiency and the City shall pay to the <br />Subdivider any overplus arising from payment based on such <br />estimate.
