the Subdivider shall and hereby does agree to extend the guarantee <br />and the warrantee in Exhibit G £or an additional period o£ time not <br />to exceed one additional year beyond the completion date o£ the <br />last such repair or replacement. <br />6. Asseasmgnf Agreement for Plan B ImprovtHiienhg - <br />A. Plan B Assessment Formula. City and Subdivider <br />agree to the assessment formula and estimated costs for Plan B <br />Improvements as set forth in Exhibit F attached hereto, and <br />Subdivider further agrees to any incidential cost changes or <br />supplemental assessments as may be necessary to cover actual <br />contract bid prices, construction change orders or other unforeseen <br />cost increases so that Subdivider's share of total improvement <br />costs remains as agreed in paragraph 6.A. above. <br />B. Lew of Special Assessments and Required <br />Prepayments. The above agreed upon snare of the installation of <br />Plan B Improvements, including any reasonable engineering, legal <br />and administrative costs incurred by the City, shall be paid by the <br />Subdivider to the City as special assessments levied against the <br />benefited land area in five (5) equal annual installments with <br />interest on unpaid installments at an annual percentage rate to be <br />established by the City at the time of the sale of the improvement <br />bonds issue, or as set forth in Exhibit F attached hereto. <br />Reference herein to special assessments shall be deemed to include, <br />and shall include, all interest due thereon. <br />-14-
