O <br /> - � C ITY of ORON4 . <br /> ,� ; � . <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> �L`�kESI3�g'�G NO. � � � � . . <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTIONS 78-350 AND 78-1288 <br /> FILE NO. 04-3009 <br /> WHEREAS,James Sheldon Loffler and Darcy Dee Loffler,husband and wife(hereinafter <br /> "the applicants")are the owners of the property located at 1690 Shadywood Road within the City of � <br /> Orono (hereinafter the "City") and legally described as follows: <br /> All of Lot 10 and that part of Lot 11, "Shady Wood",Hennepin County,lVlinnesota, described <br /> as follows:Beg-inning at the Northwest comer of said Lot 11;thence Southerly along the <br /> Westerly line thereof to the Southwest corner of the North 14 feet of said Lot 1 l;thence <br /> South 87 degrees 27 minutes East to the shore of Crystal Bay;thence North along said shore <br /> to the North line of said Lot 11;thence West along the said lot line to the point of beginning. <br /> • (hereinafter the "property"); and . <br /> � WHEREAS,the applicants have made application to the City of Orono for variance to <br /> Orono Municipal Zoning Code Section 78-350 to allow construction of anew residence to replace apre- <br /> existing residence on a lot 0.39 acre in area within the LR-1 C Zoning District where a 0.50 acre min;m� <br /> lot area is required;and a variance to Section 78-1288 to allow hardcover in the 75-250'zone at a level <br /> of 33.0%where only 25%hardcover is normally allowed. <br /> NOW,THEREFORE BE IT RESOLVED bythe City Council of Orono,Minnesota: <br /> FINDINGS � <br /> 1. This application was reviewed as Zoning File#04-3009. <br /> 2. The property is located in the LR-1C Lakeshore Residential Zoning District,which <br /> requires a minimum lot area of 0.50 acres and minimum lot width of 100'. The lot has a <br /> defined width of 80'-83',meeting the 80%rule of Section 78-72(b)(1)for existing lots of <br /> record, but is only 0.39 acres in area, not meeting the 80%rule noted above. <br /> .
