A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 1 <br />PILE #1430 <br />ffHEREAS, David Morse of Morse Homes (hereinafter "the <br />applicant") is the owner of the property located at 4127 Oak <br />Street within the City of Orono (hereinafter "City") and legally <br />described as follows: <br />Lots 1 and 2, Block 5 and Lot 1, Block 4, Minnetonka Summit <br />Park Hennepin County, Minnesota (hereinafter "the <br />property"); and <br />HJEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.22, Subdivision 1 to <br />permit the construction of a 4 foot wide tram, deck area and <br />gazebo to be located in front of the average lakeshore setback <br />line. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1430. <br />2. The property is located in the LR-lB Single Family <br />Lakeshore Residential Zoning District requiring 1 acre in <br />area. The property consists of approximately 28,000 square <br />feet in area. <br />3. The Orono Planning Commission reviewed this application <br />on August 21, 1989, and recommended approval of the proposed <br />variances as amended based upon the following findings: <br />A) The majority of the 75-2bC' lakeshore yard area is <br />located in front of the average lakeshore setback line. <br />B) The proposed location of the accessory structure in <br />relation to existing elevations provide no visual <br />impact for adjacent neighboring homes. <br />C) No hardcover variance is required for the proposed <br />deck located within the 75-250' setback area. <br />Page 1 of 4
