Option 6: Only apply the ALS when the <br />hardcover level exceeds the allowed limit. <br />•Application: <br />•The ALS would not apply to a lot with a conforming hardcover level (25%). The building limit <br />would be the shore setback requirement. <br />•For properties with nonconforming hardcover levels (over 25%), the additional ALS will be <br />applied. <br />•Analysis: <br />•Onerous. Applicants would be required to provide more information to determine the setbacks <br />on each property. <br />•Confusing for applicants. It is not an appropriate solution to address the identified challenges <br />with the ALS regulation. The ALS and hardcover limitations do not address the same concerns. <br />While both limit the development of a parcel, they do not have the same goal. Linking them <br />together is cumbersome and confusing. <br />•Recommendation: Staff does not recommend moving forward with this regulation. <br />59
