71 RESOLUTION NO. 838 <br />A RESOLUTION APPROVING NORTH ARM ESTATES FOURTH ADDITION <br />• WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted subdivision <br />regulations for the orderly, economic and safe development of land within the City; <br />and <br />WHEREAS, the City Council has considered the application for a subdivision <br />plat for North Arm Estates Fourth Addition by Engner Johnson; <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono <br />hereby approves the plat for North Arm Estates Fourth Addition, Hennepin County, <br />Minnesota; subject to the following: <br />1. The Council finding that Lot 2, Block 1, adjoins an existing <br />channel to Lake Minnetonka and that this lot will have dockage <br />rights on this channel only upon any future finding that this <br />is a legal, navigable channel. <br />2. The Council finding that Lot 1, Block 1, does not adjoin the <br />channel and therefore shall have no dockage rights regardless <br />of the navigability of the channel. <br />3. The specific finding that no easement giving access to the <br />channel shall ever be granted to Lot 1, Block 1, over Lot 2, <br />• Block 1, or any other property. <br />4. Dedication of 17 ft. additional road right of way for North <br />Arm Lane as shown on the final plat drawings. <br />5. Dedication of a flowage and open space conservation easement <br />over all the marshland and wetlands. <br />6. Payment of a Park Dedication Fee in the amount of $250.00. <br />7. Title opinion addressed to the City. <br />This resolution will expire on April 1, 1978, if the aforesaid subdivision <br />plat has not been filed with the Hennepin County Recorder's Office.
