71 RESOLUTION NO. 838 A RESOLUTION APPROVING NORTH ARM ESTATES FOURTH ADDITION • WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application for a subdivision plat for North Arm Estates Fourth Addition by Engner Johnson; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby approves the plat for North Arm Estates Fourth Addition, Hennepin County, Minnesota; subject to the following: 1. The Council finding that Lot 2, Block 1, adjoins an existing channel to Lake Minnetonka and that this lot will have dockage rights on this channel only upon any future finding that this is a legal, navigable channel. 2. The Council finding that Lot 1, Block 1, does not adjoin the channel and therefore shall have no dockage rights regardless of the navigability of the channel. 3. The specific finding that no easement giving access to the channel shall ever be granted to Lot 1, Block 1, over Lot 2, • Block 1, or any other property. 4. Dedication of 17 ft. additional road right of way for North Arm Lane as shown on the final plat drawings. 5. Dedication of a flowage and open space conservation easement over all the marshland and wetlands. 6. Payment of a Park Dedication Fee in the amount of $250.00. 7. Title opinion addressed to the City. This resolution will expire on April 1, 1978, if the aforesaid subdivision plat has not been filed with the Hennepin County Recorder's Office. In that event, it will be necessary to file a new application with the City of Orono for subdivision approval. Dated this 11th day of October, 1977. ATTEST: 4 . Walter enson, Clerk/Administrator
