RESOLUTION NO. 829 <br />RESOLUTION VACATING PART OF <br />CENTRAL AVENUE IN THE CITY <br />OF ORONO <br />ti%MREAS, the City_of Orono has received a petition dated July 5, 1977, <br />requesting vacation according to law of that part of Central Avenue abutting the <br />property of James Hartzell at 2987 Casco Point Road; and <br />WHEREAS, after due published and posted notice, a public hearing was <br />held on August 1, 1977, before the Orono Planning Commission when all interested <br />persons were given an opportunity to`be:heard; and <br />WHEREAS, no other property is affected by said vacation and no objections <br />were heard at the public hearing; and <br />WHEREAS, the travelled portion of Casco Point Road (Central Avenue) does <br />not pass over any land to be vacated; and <br />WHEREAS, the Planning Commission and City Council finds that the vacation <br />would place the legal right-of-way boundary consistent with topography and the <br />actual location of public and private improvements as maintained for many years; and <br />WHEREAS, the City of Orono will, retain sufficient right-of-way to insure <br />proper road, utility and drainage construction and maintenance; and <br />• WHEREAS, the City of Orono -finds it to be in the public interest to vacate <br />the portion of Central Avenue described herein; <br />NOW, THEREFORE, BE IT RESOLVED, that the City of Orono will vacate to <br />Mr. Hartzell for attachment to his property: <br />That part of Central Avenue, according to the recorded plat of Spring <br />Park, Lake Minnetonka, lying Southeasterly of the Northwesterly line of <br />Lot 88, said Spring Park, Lake Minnetonka, and its Northeasterly exten- <br />sion, lying northwesterly of the Southeasterly line of Lot 82, said <br />Spring Park, Lake Minnetonka, and its Northeasterly extension, and lying <br />Southwesterly of a line drawn parallel with and 30 feet Southwesterly, <br />measured at right angles, from the following described line: Commencing <br />at the most Westerly corner of Lot 103, said Spring Park, Lake Minnetonka; <br />thence on an assumed bearing of North 47 degrees 14 minutes 30 seconds <br />East along the Northwesterly line of said Lot 103 a distance of 95.74 feet <br />to the point of beginning of the line being described, said point being a <br />point in a non-tangential curve concave to the West having a radius of <br />445 feet; a tangent of said curve through said point of beginning bearing <br />North 15 degrees 56 minutes 30 seconds West; thence Southeasterly along <br />said curve through a central angle of 6 degrees 53 minutes 30 seconds an <br />arc distance of 53.52 feet; thence South 9 degrees 03 minutes East tangent <br />to said curve a distance of 200 feet; thence along a tangential curve to <br />the left having a radius of 280 feet and central angle of 37 degrees 40 <br />minutes a distance of 184.07 feet; thence South 46 degrees 43 minutes East <br />a distance of 40 feet, and said line there ending. <br />
