(Melanie <br />Curtis) <br /> <br /> <br />1.Purpose: <br />This application is regarding variances to support reconstruction of an existing lakeside accessory <br />building with plumbing. <br />2.MN§15.99 Application Deadline: <br />The application was submitted on March 19, 2025, and considered to be complete on March 25th. <br />The 60-day review period will end on May 24, 2025. <br />3.Background: <br />The applicant requests the following variances to reconstruct an existing legal, nonconforming <br />“boathouse” accessory building (with a one-foot expansion in height) due to floodplain <br />regulations: <br />A lake setback variance to allow a one-foot vertical expansion of the building, 20 feet from <br />the lake where a 75-foot setback is required; <br />An average lakeshore setback variance to allow the one-foot expansion lakeward of the <br />ALS; <br />A variance from City Code Section 78-1125 requiring a 15-foot wide rescue bench around <br />the building elevated on fill; and <br />Allow plumbing to be installed in the nonconforming building. <br /> <br />Full details of the application and the variance analysis are included in the Planner Report attached <br />as Exhibit A. <br />4.Public Comment: <br />Comments from the DNR were received and are attached as Exhibit L. <br />5.Staff Recommendation: <br />Staff recommends approval as applied subject to the Plumbing in Accessory Building covenant. <br />6.Planning Commission Action Requested: <br />Planning Commission should consider a motion to approve the variances as applied. <br />AGENDA ITEM <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Exhibits <br />Exhibit A - Staff Report <br />Exhibit B - Application & Narrative <br />Exhibit C - Practical Difficulties <br />Exhibit D - Survey <br />80
