3. <br />4. <br />5. <br />6. <br />b. <br />1. <br />2. <br />3. <br />c. <br />1. <br />2. <br />3. <br />d. <br />1. <br />2. <br />(3) <br />a. <br />b. <br />c. <br />(a) <br />(b) <br />(a) <br />(1) <br />(2) <br />(3) <br />If the property is rented, permission from the property owner to maintain animals must be obtained. <br />All shelters or attached fenced enclosures must have a minimum setback of ten feet from the rear property line and ten feet from the side property <br />line. <br />No structure or fenced animal yard shall be closer than 25 feet to any residential dwelling on the adjacent lots. <br />No structures or fenced animal yards will be allowed in the resident's front yard. <br />Shelter. <br />These animals must be provided proper shelter that is fully enclosed with a well-ventilated roof and a source to maintain adequate livable <br />temperatures during extreme heat or cold conditions. <br />The floors of the structure shall be kept clean and sanitary with body excretions collected daily and removed from the structure. <br />If a fenced animal yard enclosure is erected, the fenced-in area shall share a common wall of the structure, be securely constructed in a manner <br />complying with all other city fencing ordinances, prevent predators from getting into the fenced area, prevent the animal from escaping the fenced <br />area and be well drained so there is no accumulation of moisture. <br />Care and treatment. <br />No animal shall be allowed outside of either the shelter or properly fenced area. <br />Food materials shall be in closed sealable containers stored inside the structure of the provided shelter. <br />Animals shall maintain all required vaccinations. <br />Number and type of animals allowed with minimum square footage of each. <br />Pigeons. No more than 30 pigeons may be kept. Pigeons shall be given a minimum of one square foot of space for each pigeon. <br />Rabbits. No more than six rabbits may be kept. Rabbits shall be given space with a minimum height of 14 inches with 1.5 square feet floor space for <br />each rabbit weighing less than four pounds (small); three square feet floor space for each rabbit weighing four to eight pounds (medium size); and a <br />minimum of four-square feet floor space for each rabbit weighing more than 11 pounds (large size). <br />Chickens are allowed subject to the additional restrictions applicable to pigeons and rabbits in subsections (e)(2)a.2 through c.3 of this section, and subject to <br />the following additional restrictions: <br />Roosters are prohibited in all zoning districts in the city. <br />Chickens are prohibited in all zoning districts in the city except the AG or industrial districts, within which no more than 50 chickens may be kept. <br />Chickens (Bantam size) shall be given a minimum of two square feet inside structure space for each chicken weighing less than two pounds; (medium size) <br />a minimum of 3½ square feet for each chicken weighing two to four pounds; and (large size) a minimum of five square feet for each chicken weighing <br />more than four pounds. <br />(Code 1990, § 4-6; Ord. No. 1333, § 1, 10-1-2012) <br />Secs. 4-6—4-25. - Reserved. <br />ARTICLE II. - DOGS AND CATS <br />DIVISION 1. - GENERALLY <br />Sec. 4-26. - Running at large. <br />Authority to impound; declaration of nuisance. Any dog or cat which runs at large within the city at any time shall be subject to the provisions of this division <br />regarding impounding and destruction, and such animal shall be deemed to be a nuisance. <br />Allowing dog or cat to run at large. It shall be unlawful and deemed to be a violation of this chapter for the owner, keeper or person lawfully charged with the care <br />of any dog or cat, to permit or allow the dog or cat to run at large at any time within the city limits of the city. <br />(Code 1978, § 510.07(c), (d); Code 1990, § 4-26; Ord. No. 937, § 6, 10-19-1988) <br />Sec. 4-27. - Impoundment. <br />Impoundment for failure to pay for and obtain license. <br />In case of the failure on the part of any owner or keeper of a dog or cat to pay the license fee and to secure the license upon the dog or cat subject to license, <br />the dog or cat shall be surrendered by the owner or keeper thereof, upon demand, to any police officer of the city or any person appointed by the city council <br />as dog and cat catcher of the city, who shall cause such a dog or cat to be immediately impounded in some safe and suitable place under the care and control <br />of the custodian of dogs and cats. <br />The custodian shall keep such dog or cat for a period of time as required by M.S.A. § 347.14. <br />200
