<br />Permit. On application signed by the owner, on such form as shall be provided by the city, wherein the owner shall certify that his lofts comply with applicable building and
<br />zoning codes, and upon payment of a fee as set forth in chapter 22, a permit shall be issued to the owner, which shall remain in full force and effect unless suspended or
<br />revoked, or unless the use of the loft be discontinued for a period of one year.
<br />Right of entry for inspection. The animal control officer may enter and inspect any property or loft at any reasonable time for the purpose of investigating either
<br />an actual or suspected violation or to ascertain compliance or noncompliance with this section.
<br />Revocation of permit; hearing. A permit may be revoked by the animal control officer for the violation of any of the requirements of this section; provided that the
<br />holder of the permit shall first be given a hearing before the city council and allowed to show cause why the permit should not be revoked. The permit holder
<br />shall be given at least ten days' notice in writing of the time and place of such hearing. After said hearing, if said violation is not remedied within ten days, the
<br />animal control officer may issue a citation to appear in municipal court to answer the charges stated thereon.

<br />Sec. 10-14. - Animal waste.
<br />The owner or custodian of any animal shall be responsible for the prompt removal of any excreta deposited by his/her animal on public walks, recreational or
<br />private property.
<br />No owner or custodian of any animal shall cause or allow such animal to soil, defile or defecate on any city property, unless such owner immediately removes and
<br />disposes of all feces deposited by such animal in a sanitary manner.
<br />It is unlawful for any person owning, keeping or harboring an animal to cause or permit said animal to be on any city property without having in his/her
<br />immediate possession a device for the removal of feces and depository for the transmission of excrement to a proper receptacle.
<br />It is unlawful for any person in control of, causing or permitting any animal to be on any city property, to fail to remove feces left by such animal and dispose of it
<br />properly as described in subsection (d).
<br />Proper disposal of animal waste shall be limited to burial where lawfully permitted, flushing in the toilet, bagging for disposal in the owner or keeper's waste
<br />receptacle, and bagging for disposal in a waste receptacle designated for animal waste in a public park or park area.
<br />Disposal of animal waste in storm drains is prohibited.
<br />Disposal of animal waste in public compost is prohibited.
<br />The provisions of this section shall not apply to the ownership or use of any animals when used for police activities, farm animals or tracking animals when used
<br />by or with the permission of the appropriate authorities.

<br />Sec. 10-15. - Keeping of chickens.
<br />Purpose. It is recognized that the ability to cultivate one's own food is a sustainable activity that can also be a rewarding pastime. Therefore, it is the purpose and
<br />intent of this section to permit the keeping and maintenance of hens in a clean and sanitary manner that is not a nuisance to or detrimental to the public health,
<br />safety, and welfare of the community.
<br />Investigation and enforcement. Personnel designated by the city shall have authority in the investigation and enforcement of this article, and no person shall
<br />interfere with, hinder or molest any such officer in the exercise of such powers. The city shall make investigations as is necessary and may grant, deny, or refuse
<br />to renew any application for permit, or terminate an existing permit under this article.
<br />Limit on the number of chickens. A person may keep, harbor, or maintain care or control over no more than four chickens defined by this chapter on property or
<br />parcels greater than 12,000 square feet and less than 0.5 acres in size and zoned single-family residential, R-1, or on property designated for one family detached
<br />dwellings within a planned unit development and no more than six chickens on parcels greater than 0.5 acres in size and zoned single-family residential, R-1, or
<br />on property designated for one family detached dwelling within a planned unit development. No roosters shall be permitted.
<br />Permit required; term, consent, fee.
<br />No person shall own, keep, harbor, or have custody of any live chicken without first obtaining a permit from the city.
<br />The first permit is valid for up to two years beginning on the date of issuance and ending on December 31 of the following year. Subsequent permits are valid
<br />from January 1 to December 31. Permits are non-transferable.
<br />The fee for a permit may be imposed, set, established and fixed by the city council, by ordinance, and amended from time to time.
<br />Contiguous parcels shall be notified of city-approved permits.
<br />Application. Any person desiring a permit required under the provisions of this article shall make written application to the city upon a form prescribed by and
<br />containing such information as required by the city. Among other things, the application shall contain the following information:
<br />A description of the real property upon which it is desired to keep the chickens.
<br />The breed and number of chickens to be maintained on the premises.
<br />A site plan of the property showing the location and size of the proposed chicken coop and run, setbacks from the chicken coop to property lines and
<br />surrounding buildings (including houses and buildings on adjacent lots), and the location, type, and height of fencing proposed to contain the chickens in a
<br />run or exercise area. Portable coops and cages are allowed, but portable locations must be included with the site plan.179
