(4) <br />(5) <br />(6) <br />(a) <br />(b) <br />(c) <br />(d) <br />(e) <br />(f) <br />(g) <br />(h) <br />(i) <br />(j) <br />(k) <br />Is repeatedly at large; <br />Damages private or public property; or <br />Barks, whines, or howls in an excessive, continuous or untimely fashion. <br />Racing pigeon means a pigeon which, through selective past breeding, has developed the distinctive physical and mental characteristics as to enable it to return to its <br />home after having been released a considerable distance therefrom, and which is accepted as such by the International Federation of Racing Pigeon Fanciers or the <br />American Racing Pigeon Union, Inc. Also commonly known as racing homer, homing pigeon, or carrier pigeon. <br />Restraint means any animal secured by a leash or lead or within the real property limits of its owner. <br />Riding stables means any place that has available for hire, boarding and/or riding instruction, any horse, pony, donkey, mule or burro. <br />Rooster means a male chicken. <br />Sporting pigeon means a pigeon which, through selective past breeding, has developed the ability to fly in a distinctive manner, such as aerial acrobatics or endurance <br />flying. Examples: Rollers, Tipplers. <br />Veterinary hospital or clinic means any establishment maintained and operated by a licensed veterinarian for surgery, diagnosis and treatment of disease and injuries of <br />animals. <br />Vicious animal means any animal or animals that constitute a physical threat to human beings or other animals. <br />(Code 1977, § 8-401; Ord. No. 897, 4-22-2024) <br />Sec. 10-2. - Enforcement. <br />The civil and criminal provisions of this chapter shall be enforced by those persons or agencies designated by the city police department. It shall be a violation of this <br />chapter to interfere with the police department in the performance of its duties. <br />(Code 1977, § 8-415) <br />Sec. 10-3. - Restriction on number of animals. <br />No person, firm or corporation shall harbor more than three dogs or three cats, or any combination of the two animals up to three in number, over the age of six months <br />in any one residential unit or place of business. <br />(Code 1977, § 8-402) <br />Sec. 10-4. - Running at large prohibited. <br />It shall be unlawful for any person who owns, harbors, or keeps an animal, or the parents or guardians of any such person under 18 years of age, to allow such animal to <br />run at large. <br />(Code 1977, § 8-403) <br />Sec. 10-5. - Licenses for dogs. <br />Any person owning, keeping, harboring, or having custody of any dog over six months of age within the city must obtain a license as herein provided. <br />Written application for licenses shall be made to the licensing authority which shall include the name and address of the applicant, a description of the dog, the <br />appropriate fee, and rabies certificate issued by a licensed veterinarian or an antirabies clinic showing that the dog is protected by an anti-rabies vaccine. Every <br />application for a neutered or spayed dog shall be accompanied by a statement from a licensed veterinarian showing that the dog has been so altered. <br />An application for a license must be made within 30 days after obtaining a dog over six months of age, except that this requirement will not apply to a <br />nonresident keeping a dog within the city for not longer than 60 days. <br />License fees shall be waived for dogs trained to assist handicapped persons. <br />Upon acceptance of a license application and fee, the licensing authority shall issue a durable tag stamped with an identifying number and year of issuance. <br />Dogs must wear identification tags or collars at all times when off the premises of the owner. <br />The licensing authority shall maintain a record of the identifying numbers of all tags issued and shall make this record available to the public. <br />All licenses shall expire one or two years (depending of the license issued) from the date of issue. <br />A license shall be issued after payment of the application fee as set forth in chapter 22. <br />Duplicate licenses may be obtained upon payment of a replacement fee in the amount as set forth in chapter 22. <br />No person may use any license for any dog other than the dog for which it was purchased. <br />(Code 1977, § 8-404) <br />176
