A RBSOLDTIOif GR^JITIIiG <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 & 2 AND <br />SECTION 10.55, SUBDIVISION 8, AND <br />GRANTING A CONDITIONAL USB PERMIT PER <br />SECTION 10.03, SUBDIVISION 19 <br />FILE #1391 <br />WHEREAS, Terry Sadler (hereinafter "the applicant") is <br />the owner of the property located at 1396 Baldur Park Road within <br />the City of Orono (hereinafter "City") and legally described as <br />follows: <br />Lot 16, Baldur Park, Hennepin County, Minnesota (hereinafter <br />"the property"); a.id <br />WHEREAS, the applicant has made application to the City <br />of Orono to permit construction of a retaining wall and placement <br />of fill within the 0-75* lakeshore setback zone, requiring a <br />variance to Municipal Zoning Code Sectj.ons 10.22 Subdivision 1 <br />and 2 and 10.55, Subdivision 8, and a conditional use permit per <br />Municipal Zoning Code Section 10.03, Subdivision 19. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1391. <br />2. The property is located in the ,LR-1C Single Family <br />Lakeshore Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on May 15, 1989 and recommended approval of the proposed <br />variances and conditional use permit, per the <br />recommendations of the City Engineer, based on the following <br />findings: <br />A) The applicant's proposal included a retaining wall <br />constructed along the lot line to a point as close as <br />40* to the shoreline, with fill being placed as close <br />as 35* from the shoreline. The City Engineer <br />recommended that the wall be no closer than 70* from <br />the shoreline with fill no closer than approximately <br />45* to the shoreline. <br />Page 1 of 5
