A RSSOI.UnON GRANTING <br />A CONDTIONAL USB PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 19 <br />PILE #1409 <br />WHEREAS, Jann and Renee Olsten (hereinafter "the <br />applicants") are the owners of the property located at 3090 <br />Farview Lane within the City of Orono (hereinafter "City") and <br />legally described as Lot 2, Bloclc 2, Farview, Hennepin County, <br />Minnesota (hereinafter "property"); and <br />WHEREAS, the applicants have applied to the City of <br />Orono for a conditional use permit to permit land alterations <br />involving excavation, filling, and the installation of retaining <br />walls on the property per Municipal Zoning Code Section 10.03, <br />Subdivision 19. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1409. <br />2. The property is located in the RR-IB Rural Residential <br />Zoning District requiring 2 acres in area. The property <br />consists of 2+ acres. <br />3. On May 15, 1989, the Orono Planning Commission reviewed <br />the application as proposed and recommended approval based <br />on one or more of the following findings: <br />A) The proposed land alterations on the property will <br />have no negative impact on the existing drainage <br />patterns nor will there be a change in drainage. <br />B) The level area on the lot would be increased with <br />the proposed alterations allowing more surface run-off <br />to percolate into the soils. <br />4. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Commission, reports by staff and comments of the applicants <br />and the affect of the proposed use on the health, safety, <br />and welfare of the community. <br />Page 1 of 4
