Toberman (hereinafter "the applicant") is ch <br />owner of Smith Bay Marina located at 1955 Shoreline Drive within the Cit <br />of Orono (hereinafter "City") and legally described as follows: <br />Commencing at the intersection of the North line of Central Avenu <br />extended Easterly with Easterly right-of-way line of County Road No. <br />thence Northeasterly 42 degrees 15 minutes East 120.05 feet to actua <br />point of beginning thence South 57 degrees 45 minutes East 29.04 fee <br />thence North 37 degrees 50 minutes East 130 feet to the intersectic <br />of North line of Grand Avenue extended Easterly thence North 5 <br />degrees 45 minutes West 18 feet nee Southwesterly 42 degrees 1 <br />minutes West 131.05 feet to begin: including accretions, "ORA PARI <br />ON LAKE MINNETONKA", Hennepin ^junty, Minnesota (hereinafte <br />"property"); and <br />WHEREAS, the applicant has made application to the City of Oror <br />per Section 10.03, Subdivision 19 and Section 10.55, Subdivision 8 t <br />permit installation of 280 lineal feet of seawall adjacent to the shorelin <br />of the Smith Bay Marina. <br />Minnesota ; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Oronc <br />FINDINGS <br />1. This application was reviewed as Zoning File #1215. <br />2. The property is located in the B-2, Lakeshore Commercial Zonir <br />District. <br />3. The property is approximately 0.71 acre in area. <br />4. The Orono Planning Commission reviewed this application c <br />November 16, 1987, and recommended approval of the propose <br />conditional use permit and variance as proposed based on the followir <br />findings : <br />A) Seawall will allow maximum use of limited land area f: <br />parking and storage. <br />Page 1 of 4
