City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2194 <br />CONCLUSIONS. ORDER AND CONDITIONS <br />'BTsed upon one or more of the above findings, the Orono Cit <br />Council hereby grants the variances as set forth above and approves th <br />commercial site plan dated April 20, 1987 by R.L. Wuornos and Associate <br />for Smith's Bay Marina & Yacht Club, Inc., subject to the followir. <br />conditions: <br />1. Owner to execute a Developer’s Agreement and post a letter c <br />credit with the City to insure the following improvements ar <br />installed by August 31, 1988. <br />a) Drainage/surface water treatment improvements per final plai <br />approved by the M.C.W.D. and City of Orono — the City would as <br />that an unde^-ground drainage tile system be located and its ui <br />reviewed as part of that improvement. <br />b) Paving of parking area, lighting, signage, and installatic <br />of grassed area per plans by R.L. Wuornos and Associates date <br />4/20/87. <br />c) Reconstruction of dock adjacent to shoreline in conjunctic <br />with shoreline restoration ~ areas of dock located above th <br />929.4 elevation not to exceed a 6 feet width. <br />d) To construct a six feet high privacy fence along the wes <br />side lot line adjacent to the public access. <br />2. The executed Developer’s Agreement and letter of credit (amount t <br />be 150% of the cost of requirement improvements) must be submitted t <br />the City prior tc application for a building permit for new principa <br />structure. City Engineer shall review total estimate of improvemer <br />costs prior to submittal of letter of credit. <br />3. Erosion control shall be employed at all times on the site durir <br />the time of the construction of the principal structure and t. <br />shoreline restoration. <br />4. Owner/applicant shall apply for a building permit with penalty f <br />for commercial dock constructed prior to his ownership of t <br />property. <br />5. Demolition permits are required for all buildings to be remove <br />Such permits must be obtained by applicant at the time a permit <br />issued for new construction, A certificate of occupancy will not <br />issued for the new structure until all buildings designated f- <br />removal have been razed. <br />6. Owner/applicant is hereby advised that at the time an applicati <br />for building permit is submitted to the City, the Orono staff sha <br />evaluate the proposed improvement and uses of the property p( <br />standards adopted by Metropolitan Waste Control Commission in t.' <br />determination of Service Availability Charges to be collected with tl <br />issuance of a building permit. <br />Page 3 of 5
