A RBSOLOTION GRAMTIIIG <br />A VARIANCE TO <br />NIINICIPAL ZONING CODE <br />SECTION 10.24, SUBDIVISION 5 (B) <br />FILE #1404 <br />WHEREAS, John D. Miklethun (hereinafter "the <br />applicant") has an Interest in the property located at 1385 <br />Cherry Place within the City of Orono (hereinafter "City") and <br />legally described as fellows: <br />Tract B, Registered Land Survey No. 615, Piles of the <br />Registrar of Titles, Hennepin County, Minnesota (hereinafter <br />"the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municxpal Zoning Code Section 10.24, Subdivision 5 <br />(B) to permit the construction of a single family residence on a <br />lot of 0.456 acres (19,873 square feet) in area, where a lot size <br />of 1.0 acres (43,560 square feet) is normally required for <br />construction of a single family residence. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1404. <br />2. The property is located in the LR-IB Single Family <br />Lakeshore Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on May 15, 1989 and recommended approval of the proposed <br />variance based upon the following findings: <br />A) Municipal sewer is available and has been assessed <br />to the property. <br />B) A hous<^ Isted on the property since prior to <br />1956.
