A RESOLUTION GRANTING <br />AN AFTKR-THB-PACT VARIANCE TO <br />NUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 12 <br />FILE #1401 <br />WHEREAS, John and Nancy Feibelkorn (hereinafter "the <br />applicants") are the owners of the property located at 2730 <br />Shadywood Road within the City of Orono (hereinafter "City") and <br />legally described as follo')^: <br />Tract Cr Registered Land Survey No. 420, Hennepin County, <br />Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for an <br />after-the-fact variance to Municipal Zoning Code Section 10.03, <br />Subdivision 12 to permit the construction of a permanent storage <br />structure located 9.5* from the existing residence where a 10* <br />structure-to-structure setba^. c is normally required. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota; <br />FINDINGS <br />1. This application was reviewed as Zoning File #1401. <br />2. The property is located in the LR-IB Single Family <br />Lakeshore Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on May 15, 1989 in conjunction with a proposed lot line <br />rearrangement to make the accessory storage building in <br />question conforming to the required side lot line setback, <br />and recommended approval of thi:^ structure-to-structure <br />setback variance based upon the following findings: <br />A) The storage building has a permanent foundation <br />which makes it impossible to move without rebuilding <br />the foundation. <br />D) The structure has no significant impact on <br />neighboring properties. <br />Page 1 of 4
