ft <br />• <br />RESOLUTION N0. <br />AUTHORIZING TAKING OF EAS MENTS IN LAND <br />BY EMINENT DOMAIN <br />FOR SANITARY SEWER PURPOSES <br />SANITARY SEWER PROJECT 73-1 <br />WHEREAS, the City Council has ordered preparation; of <br />a resolution authorizing the taking of an easement in lard by <br />eminent domain and the City Engineer has recommended the acqusi- <br />tion of easements in land for sanitary sewer purposes at the <br />locations hereinafter specified, and it appears to the Council <br />that it is necessary that the City acquire such lands, therefore <br />BE IT RESOLVED by the City Council of Orono: <br />1. That it is hereby determined that the taking in <br />easement of the tracts and parcels of land set forth in paragraph. <br />three (3) hereof is necessary for the public good in order that <br />said tracts and parcels shall be devoted to sanitary sewer pur- <br />poses. <br />2. That the City shall take by right of eminent <br />domain for sanitary sewer purposes an easement in the lands des- <br />cribed in paragraph three (3) hereof, and the City Attorney be <br />hereby authorized and directed to commence proceedings in the <br />District Court of Hennepin County for appointment of Commissioners <br />to determine the damages, if any sustained by the respective owners <br />of the parcels affected by such taking, as authorized by law, and <br />3. That the lands referred to above are more parti- <br />cularly described as follows: <br />DESCRIPTION OF EASEMENT: <br />A 20 foot wide permanent easement for sanitary sewer and lift <br />station purposes over, under, and across Lot 13 Partens Point <br />First Division according to the plat on file in the Office of <br />the Register of Deeds, Hennepin County, Minnesota. The center <br />line of said easement is described as follows: <br />Commencing at the southwest corner of said swot. 13, thence <br />easterly along the southerly line thereof 1.73.0 feet to the point <br />of beginning of the centerline to be described; thence northerly <br />to a point on the northern- lire of said Lot 13, said point <br />being 154.0 feet easterly of the northwest corner of said Lot 13 <br />as measured along the northerly line of said Lot 1.3 and said <br />• center line there terminating excepting therefrom the permanent <br />structures thereon. And also a permanent easement for sanitary <br />sewer and lift station purposes over, under, and across the <br />northerly 20 feet of said Lot 13 excepting therefrom the perma- <br />nent structures there n. <br />
