A RESOLUTION GRANTING <br />A CONDTIONAL USB PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 19 <br />FILE #1367 <br />MHBRBAS, Steven M. Harris, (hereinafter "the <br />applicant") is the owner of the property located at 3850 <br />Watertown Road within the City of Orono (hereinafter "City") and <br />legally described as Lot 1, Block 1, Hillaway Farm, Hennepin <br />County, Minnesota (hereinafter "property"); and <br />WHEREAS, per Municipal Zoning Code Section 10.03, <br />Subdivision 19, the applicant has applied to the City of Orono <br />for a conditional us.; permit to permit the installation of a <br />pond 100* in diameter and 4* deep. <br />HOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, .xnnesotat <br />FINDINGS <br />1. Tills application was reviewed as Zoning Pile #1367. <br />2. The property is located in the RR-lA Rural Residential <br />Zoning District requiring 5 acres in area. The property <br />consists of 10+ acres. <br />3. On April 17, 1989, the Orono Planning Commission <br />reviewed the application as proposed and recommended <br />approval based on the following findings: <br />A) The City Engineer has confirmed that the <br />installation of the pond will have no negative impact <br />upon the drainage to the west nor to the south. <br />B) The installation of the pond will have a positive <br />impact on the drainage in the area providing greater <br />retention wthin the limited watershed. <br />C) The application as proposed will require no <br />variances to the standards of Section 10.03, <br />Subdivision 19. <br />Page 1 of 4
