#1135 Robert Hanning, 4220 Sixth Avenue North - <br />Request for Extension of Conditional Use Permit <br />May 5, 1989 <br />Page 2 of 2 <br />Mr. 6 Mrs. Hanning will be present to discuss any questions <br />Council may have concerning their special request. Council <br />should be aware that we have a $5,000.00 Letter of Credit <br />covering the final excavation work and seeding if applicants fail <br />to do so by the expiration date. The expiration date of the <br />Letter of Credit is June 1, 1989. <br />Options of Action Available to Conncil - <br />1. Denial and require that the immediate disturbed area be <br />regraded and prepared for seeding. Such work to be <br />completed by May 24, 1989 so that staff will have adequate <br />time to complete the final inspections to determine if it is <br />necessary to draw upon the Letter of Credit before the June <br />1st deadline. <br />2. Approval of the applicants' request as presented subject to <br />the following conditions: <br />A) Applicant provide an additional $100.00 to the <br />City to cover the additional inspections by staff <br />through the summer. The original $200.00 for <br />Application #1135 has been expended with the many staff <br />inspections. These inspections also included <br />inspections with the consultant engineer and other <br />problems pertaining to the quality of fill. <br />B) E: tension of Letter of Credit to October 30, 1989 <br />providing the City with an additional months time <br />beyond the final work completion date established by <br />applicant (September 30, 1989). Extension of Letter of <br />Credit to be submitted prior to the next Council <br />meeting of May 22, 19B9. <br />3. Table the application before final action requiring <br />applicants to submit foral written confirmation that they <br />will be in receipt of an adequate supply of fill within the <br />following summer months. Upon review of the written <br />committments or contracts. City to considering approving an <br />extension subject to the same conditions noted above in <br />Option 2.
