43. The amount of light and air in the neighborhood would <br />be diminished by adding structures on each of the <br />substandard lots. <br />44. The values of surrounding properties would be adversely <br />affected by adding structures on each of the substandard <br />lots. <br />45. There are no special conditions applying to the land in <br />question which are peculiar to the land or immediately <br />adjoining property. <br />46. The granting of the variances is not necessary for the <br />preservation and enjoyment of a substantial property right <br />of the applicant. <br />47. The granting of the variances will serve mainly as a <br />convenience to the applicant, and is not necessary to <br />alleviate demonstrable hardship or difficulty. <br />HOW, THBRBFORB BB IT FORTHBR RBSOLVBD, that the City <br />Council of the City of Orono hereby denies the requested lot area <br />and lot width variances for construction of a single family <br />residence on Parcel 2; and similarly denies the requested lot <br />area and width variances for construction of a single family <br />residence on Parcel 3, based u^.on one or more of the above noted <br />findings of fact concerning this property. <br />BB IT FURTHBR RBSOLVBD, that the City Council of the <br />City of Orono hereby additionally denies the request to separate <br />these non-conforming, undeveloped, sub^-^andard, contiguous, <br />unsewered lots of record under common ownership. <br />BB IT FURTHBR RBSOLVBD, that the City Council of the <br />City of Orono, in order to put all parties on notice that the <br />above referenced substandard lots in common ownership must remain <br />under common ownership to maintain the existing house on a <br />conforming lot size, hereby directs the City staff to file this <br />resolution against the chain of title of the properties legally <br />described herein. <br />Page 12 of 13
