7. On October 12, 1959, the Council adopted Ordinance No. <br />22 establishing a minimuio building lot size of 1 acre and <br />minimum 140* width at the building line for all building <br />lots. Ordinance No. 22 also allowed the Council, at their <br />option, to grant variances for existing lots in single <br />separate oioiership that do not meet these standards. <br />8. On September 14, 1967, the Council adopted the Orono <br />Zoning Ordinance designating the R-lC zoning district in <br />which the property is located, requiring a minimum of 1 acre <br />in area and 140* minimum width. <br />9. On January 1, 1975, the current zoning ordinance came <br />into effect, rezoning this property to RR-lB, Rural <br />Residential zoning district, requiring a minimum lot size of <br />2.0 acres in area and 200* minimum width. <br />10. Mr. Ferrell has retained ownership of Parcels 1, 2, and <br />3 since their creation as a result of the 1958-1959 <br />subdivision. <br />11. On March 18, 1985, Mr. Ferrell requested City staff to <br />accept a variance application for approval to construct a <br />new home on Parcel 3. At staff recommendation, Ferrell <br />submitted the application as a zoning appeal in order to be <br />granted a timely review and recommendation by the Planning <br />Commission without submitting the complete survey and soil <br />testing information required. <br />12. Pursuant to the zoning appeal application, the Planning <br />Commission held a public hearing on that matter. Application <br />#903, on April 15, 1985. The Planning Commission confirmed <br />that many variances were necessary to build on either Parcel <br />2 or 3. The Planning Commission noted ^t the property <br />consists of 4 separate tax parcels which . contiguous and <br />which are owned in common by the applicant. The property in <br />total contains approximately 2.90 acres and has a defined <br />width in excess of 600* in both respects meeting the area <br />and width requirements for the single existing residence on <br />the property. The Planning Commission determined that the <br />following variances were required in order to allow new <br />residences to be constructed on either of Parcels 2 or 3: <br />Parcel 1 (with existing house) <br />a) Lot Area Required « 2.0 acres <br />Existing « 1.01 acres or 50.5% <br />Variance * 0.99 acres or 49.5% <br />Page 4 of 13
